RESCUE ID, LLC - Privacy Notice

This Privacy Notice describes how RESCUE ID, LLC (“RESCUE ID”, “we”, “us”, “our”) collects, uses, shares, and otherwise processes your personal information when you access or use our websites, products, or services (collectively, the “Services”), including RescueID.com.

This Privacy Notice applies to individual customers and users who visit or use our Services, but does not apply to members of a business or governmental organization that purchased our Services on your behalf as we act as a service provider/processor to that business or organization. It also does not apply to websites, products, or services that link to its own privacy notice or that are offered by third parties (in which clicking on third-party links or enabling those connections may allow the third party to process data about you).

By using our Services, you confirm you read, understood, and acknowledge this Privacy Notice and how we handle your personal information.

1. Personal Information We Collect

“Personal information” means information linked or reasonably linkable to an identifiable individual, but does not include anonymized or deidentified data that cannot reasonably be linked to an individual.

Information You Provide to Us

You may voluntarily provide us with the following categories of personal information, including as examples when you correspond with us by email, complete a form on our website, registering for and using our online services, or create and maintain a RESCUE ID profile containing emergency profile information (“Emergency Profile”). Typically, we collect the following personal information:

  • Identifiers and contact information (such as full and preferred name, home, billing, or shipping address, email address, phone number, emergency contact name, contact information, and relationship to you, and account members’ name, contact information, date of birth, and relationship to you).
  • Demographic data (such as date of birth, gender, height, and weight).
  • Personal photographs (that you upload to us).
  • Medical information (such as medical conditions (e.g., current medical conditions, allergies, medications, blood type), medical history (e.g., past medical and surgical history), mental or behavioral conditions and preferences (e.g., specific conditions, special needs, response guidance and de-escalation preferences), mental or behavioral health clinic or support names and contact information, physician or provider information (e.g., primary physician name and contact information, preferred hospital), and advance directives (e.g., Do Not Resuscitate (DNR) preference/status)).
  • Account and security information (such as login credentials (e.g., username/password) and two-factor authentication methods (e.g., phone number or email).
  • Commercial information (such as subscription status and plan type, product and purchase history, and payment and billing information (e.g., payment card information). Please note any payment card information is only stored by our third-party payment processor (e.g., Stripe)).
  • Legal documents and similar that you upload (such as Physicians Orders for Life Sustaining Treatment (POLST), Power of Attorney (POA), and other guardian legal forms, funeral home information, and any other documents or information that you upload to us (e.g., emergency profiles for schools, employers, or law enforcement)).
  • Your interests (such as interests in public safety or your and your family’s safety and interests in products and services related to such safety).
  • Any other personal information that you provide or someone provides on your behalf.

Please note you are solely responsible for all personal information provided by you to us, whether relating to you or your account members or emergency and other contacts, including that you have the right to provide us with that personal information as well as the content of that personal information (including the accuracy and completeness of that information).

If you create an account or Emergency Profile for another person (such as a family member or dependent), you represent and warrant, with respect to that individual’s sensitive, personal, and other information, that: (a) you have the legal authority to consent to the collection, processing, and public disclosure of their information; (b) you have obtained that individual’s informed consent (or, for minors under 18, parental consent) to the collection, processing, and public disclosure of their information; and (c) the information you provide about that individual is accurate, updated, and complete.

Information Collected Automatically

We also automatically collect personal information, including as examples when you visit, access, or use our websites, mobile applications, and online services, access a RESCUE ID Emergency Profile, or when we communicate with you. We may automatically collect the following personal information:

  • Device, browser, and other technical information (such as IP address, device IDs, user agent, internet service provider, referring URLs, and device/browser type and settings).
  • Usage and browsing information (such as pages accessed, feature usage (e.g., downloads, sharing, alerts triggered), timestamps (e.g., date and time) and session lengths, account and profile updates, activity history, performance metrics (e.g., number of visits, bounce rate, traffic source), and, when our QR codes are scanned, scan event metadata (such as profile owner, scan frequency and duration)).
  • Open rates and interactions with our advertisements or communications.
  • Location data (such as city/state-level information or latitude/longitude).
  • Account status (such as subscription and billing status).
  • Notification delivery logs (such as notifications sent via SMS or email).
  • Preferences (such as your settings and preferences).
  • Interests (such as interests in public safety or your and your family’s safety, and interests in products and services related to such safety).

2. How We Use Personal Information

We use personal information for the following purposes:

  • To provide our Services, such as allowing you to register an account, activate products, and maintain your and your account members’ profiles, process your purchases, subscriptions, and renewals, to provide you with support, to provide access to Emergency Profile(s) – including your sensitive personal information, if included, to send alerts to designated contacts, and to communicate with you about our Services and related transactions.
  • To facilitate use of our websites and other Services, and to ensure our content is relevant to you.
  • For our product, account, and business operations, such as to operate, improve, or personalize our Services and related platform infrastructure, as well as your user experience, to develop new products, services, content, and other offerings, to monitor and audit the usage of our Services, products, networks, devices, and related infrastructure, to ensure the security of, and detect fraud and abuse of, our Services, products, networks, devices, and related infrastructure, and to manage our internal operations (such as account administration, asset deployment, billing, troubleshooting, and repair).
  • To engage and communicate with you, including to respond to your requests, for safety reminders and recommended actions, account or profile update prompts, product updates and enhancements, new features, services, or offerings, promotional or marketing communications, sending you personalized and interest-based advertising and marketing, to improve and develop new marketing campaigns, segments, and materials, and to enable you to partake in a prize draw or competition or complete a survey. Please note you may opt out of our marketing communications (e.g., emails) at any time.
  • For public safety purposes, including to support emergency, law enforcement, and other governmental agencies, and for public safety investigations (e.g., for abducted or missing persons).
  • Comply with legal obligations or exercise our rights and protect our or others’ rights or property.
  • Effectuate the sale, merger, acquisition, or other disposition of our business.
  • For other purposes as required by or permitted by law.

3. When and with Whom We Share Information

We share personal information in the following circumstances:

  • When and to whom you direct us to share your information, including as examples to account members, doctors or other healthcare providers, caregivers or family members, schools, camps, employers, government or safety organizations, and others you choose.
  • Your organizations and affiliates (and their administrators and personnel) if your account is part of a business, government, or other deployment.
  • To anyone who accesses your Emergency Profile which access may occur with or without your prior consent, including as examples emergency responders, law enforcement, healthcare personnel, and other professionals who access your Emergency Profile in an emergency situation.
  • To the Emergency Profile owner (or the account holder) when their Emergency Profile is scanned.
  • To attorneys, courts, law enforcement, and governmental agencies, including as examples to comply with subpoenas, orders, or legal processes, cooperate in investigations, support missing-person or abduction investigations, or to prevent imminent harm or protect our rights and rights of others.
  • To our third-party service providers, including as examples our advisors, insurance providers, software and technology providers, cloud hosting providers (e.g., AWS), payment processors (e.g., Stripe), messaging providers (e.g., Twilio), email delivery providers, marketing providers, analytics and performance monitoring providers, manufacturers/printers of products, and shipping carriers.
  • To a successor entity in the event of a merger, acquisition, sale, or disposition of our business or assets.

RESCUE ID does not sell personal information and does not share personal information for third-party commercial marketing purposes. To be clear, when you enroll to receive SMS (text) messaging alerts from us (including providing your mobile phone numbers for SMS notifications), this information will not be shared with any third parties or affiliates for marketing or promotional purposes.

4. Your Consent to Publicly Publish and Share Your Personal Information

By completing and maintaining an Emergency Profile containing your personal information, you are directing us and hereby consent for us to publicly publish your and your account members’ Emergency Profile(s), and all personal information contained therein, so that it is accessible by anyone with access to your unique link/URL or QR code, including by first responders and other emergency personnel who scan the QR code on your RESCUE ID cards or other products. This is the primary and essential purpose of our services, and you have directed us to make this information accessible (including to emergency responders) by creating and activating your Emergency Profile and uploading personal information.

You acknowledge and understand that the nature of our products and services are such that the Emergency Profile (and any information, including personal information, contained therein) cannot be encrypted or password-protected at the point of access, because doing so would prevent emergency responders or others from accessing it in an emergency; therefore, you agree to accept the risk that all information, including personal information, you include in your and your account members’ internet-accessible Emergency Profile(s) is made publicly accessible by default and can be accessed by anyone with your unique link/URL or QR code – including by unauthorized third parties. We cannot prevent unauthorized access to your Emergency Profile if your QR code or URL is obtained without your consent.

You also acknowledge and consent to the sharing of your Emergency Profile and any information, including personal information, therein, to anyone who accesses your unique link/URL or QR code, including by first responders and other emergency personnel (some of whom may be law enforcement or other governmental agencies) who scan the QR code on your RESCUE ID cards or other products, who may or may not obtain your prior consent to do so.

You agree that if there is any information, including personal information, for which you or your account members do not want to be made publicly accessible, then you will either not include that information in your or their Emergency Profile(s).

5. Data Security

RESCUE ID works to implement technical and organizational measures designed to protect the security of personal information, proportionate to: (a) the size and complexity of our organization; (b) the nature and scope of our activities and services; and (c) the sensitivity of the personal information we collect.

However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee its absolute security. As described above, your Emergency Profile (including all personal information included) is designed to be publicly accessible via your unique QR code or URL so that emergency responders or others can access it without delay. This means that, by creating and activating an Emergency Profile, you are directing us to make your personal information accessible to the public.

The security of your information also depends on you: you are responsible for using unique, strong usernames and passwords for each of your accounts and for keeping those login credentials confidential.

We are not responsible for the circumvention of any privacy settings or cybersecurity measures contained in our Services, and any transmission of personal information is at your own risk. If a breach of our security safeguards results in the unauthorized access to your personal information, we will notify you as required by applicable law in accordance with the timelines required by those laws.

6. Data Retention

We retain personal information for as long as is necessary to fulfil the purpose for which it was collected and any other permitted purpose. Our retention periods are based on our business needs, regulatory retention requirements, and industry standards. For example, we retain personal information while your account or subscription is active and for a reasonable period after account termination (not to exceed 30 days) unless a legal requirement or our internal retention policies requires us to retain that personal information for a longer period (in which case we will retain it until that requirement expires).

7. Children’s Privacy

Our Services are not directed to individuals under the age of 18 and we do not knowingly collect information directly from minors (including children). Individuals who are 18 or older may create Emergency Profiles for minor dependents, in which:

  • The account holder acts as the authorized representative for the minor and consents to the collection, processing, and public disclosure of the minor’s sensitive and other personal information;
  • A minor’s Emergency Profile is subject to enhanced visibility restrictions (e.g., minor’s phone number, address, or date of birth will not be visible; however, all other information you include, including their sensitive medical information will be visible);
  • A parent or legal guardian may access, correct, or delete a minor’s personal information at any time through the Services itself or by submitting a request to us; and
  • The account holder must not allow those minors to directly use the Services.

8. Rights over Your Personal Information

Depending on where you are a resident, your local privacy laws may grant you rights with respect to your personal information. These rights differ based on the local laws that apply to you, but could include one or more of the following: (a) right to access a copy of your personal information, (b) a right to correct or delete your personal information, and/or (c) the right to opt-out of certain uses of your personal information (including to opt-out of marketing communications from us).

Importantly, these rights are not absolutely guaranteed and there are several exceptions that may apply. We are required to honor these rights only to the extent we act as a controller of that information, and the requested rights have been granted and apply to you under applicable privacy laws.

You may request to exercise one of these rights by emailing us at: info@rescueid.com. We may require you to verify your identity before fulfilling your request. Once verified, we will respond to your request in the timelines required by applicable law. We will not knowingly discriminate against you because you have exercised your privacy rights.

You may appeal an adverse decision on your requests by emailing us, and you have the right to lodge a complaint to your state’s attorney general if you are not satisfied with our response or how we manage your personal information. That said, we encourage you to contact us first to address your concern.

9. Not Intended for International Users

RESCUE ID is intended for individuals located in the U.S. only. If you are outside the U.S., you consent to data transfer and storage in the U.S., and acknowledge the U.S. may provide less protection than your country’s privacy laws (including that U.S. government authorities could access your personal information).

10. Changes to This Privacy Notice

This Privacy Notice is expected to change over time. We reserve the right to update it at any time for any reason. We will notify you of changes to our Privacy Notice by updating the “last updated” date and posting the updated Privacy Notice on this page. We may also contact you with periodic reminders of our notices or when required if we make material changes, but you should check this page frequently to see the current Privacy Notice and any changes made to it.

11. Controller/Business & Contact Information

RESCUE ID acts as a ‘controller’ or (‘business’) of your personal information where we determine how and why it can be used, but we are not the controller where we act as a service provider to a business or government organization that purchased our Services on your behalf.

This Cookie Policy supplements our Privacy Notice and specifically explains how we and our third-party business partners deploy cookies and other tracking technologies (we refer to these as “Cookies”), and the options you have to control them. This Cookie Policy should be read together with our general Privacy Notice, which provides broader information about our data practices

As used in this policy, Cookies includes both: cookies, which are small text files placed on browsers, computers, and other devices to hold data; and web beacons, including tags, pixels, embedded scripts, and similar tracking technologies, which are temporarily pieces of code activated on or downloaded to your browsers, computers, and other devices. These Cookies may be set by us or by our third-party business partners, such as social media networks, advertising networks, and content providers. They can be set either for a single visit (a session cookie/tracker) so they are deleted after that visit or to remain on your device to persist for multiple repeat visits (a persistent cookie/tracker).

We use Tracking Technologies for several purposes, including:

  • to remember you and your preferences;
  • to understand how you interact with us so that we may perform certain functions, such as providing our products and services or delivering content and allowing users to register and remain logged in;
  • to personalize our products, services, and content and ensure a quality, consistent, and efficient experience for our users;
  • to analyze your usage and interactions with us and our products, services, and content, including emails sent to you;
  • to deliver advertisements (“ads”) to you (including Personalized Ads), and to understand your interactions with our ads or to measure our ad or market reach, attribution, and similar metrics; and
  • to collect information about your online activities, which may be over time and across devices, third-party websites, or other online services.

“Personalized Ads” generally means advertisements (ads) or other marketing content tailored to your interests and demographics. We or our third-party business partners may send you Personalized Ads and these ads may be based on the information collected through Cookies, other information that we collected, and/or other information that third parties independently collect (such as through their own websites or across different websites). Please note that we do not control the privacy practices of these third parties and their privacy practices are not covered by our Privacy Notice or Cookie Policy.

You may wish to restrict the use of Cookies:

  • Most modern browsers allow you to control Cookies by changing your cookie and other tracker settings in your browser’s options or preferences menu.
  • You may also see a ‘cookie banner’ on our websites and online services, in which clicking on that banner allows you to learn more about which Cookies are used and what you may disable.

In addition to the above, you may also be able to choose not to receive Personalized Ads from third-party companies that participate with any of the following:

  • The Digital Advertising Alliance (DAA), in which you may opt out using this tool;
  • The Network Advertising Initiative (NAI), in which you can learn how to opt out here;
  • The AppChoices App for opting out on mobile devices, in which you can learn more here.

Certain mobile devices may also have an advertising identifier that allows companies to serve Personalized Ads to a specific mobile device using that identifier, and you may be able to reset or limit the sharing of that advertising identifier, as well as turn off the device’s location tracking. See your device manufacturer to understand which options are available to you.

Please note that:

  • you cannot disable any Cookies that are categorized as strictly necessary;
  • some features may not function correctly if you disable any or all Cookies;
  • we do not currently respond to a web browser’s “do not track” signals;
  • some of the options described above are browser- or device-specific, so you may need to change your settings or otherwise opt out again if you use a different device or browsers; and/or
  • even if you opt out of receiving Personalized Ads, you may still receive advertisements but they may not be personalized to you specifically.
